Description: On May 13, 2019, plaintiff was arrested and prosecuted as a result of detective Robert Arnold's criminal complaint that plaintiff committed the following crime: 1) Criminal Contempt in the Second Degree; 2) Stalking in the Fourth Degree, and 3) Harassment in the Second Degree. Detective Arnold alleged that plaintiff sent 10 emails between September 17, 2018 and October 18, 2018, violating an order of protection. However, there was no proof that plaintiff sent the alleged emails, nor were the emails ever produced. Further, at the time of the allegations, the order of protection had long expired. Because of a lack of evidence, the case was dropped and prosecution was dismissed.

Defendant Detective Hiddessen utilized NYPD procedures and systems to have an I-Card issued for Plaintiff Giles claiming to have probable cause for Plaintiff Giles' arrest based on false, erroneous, and/or misrepresented statements of Plaintiff Giles' involvement in the shooting.
