Complaint
Description: On October 2, 2014, Plaintiff Khrist Newman was preparing to begin a street performance when stopped by Defendant PO David Gomez and POs John Does 1-2, who demanded that Plaintiff hand over his speaker despite no music emanating from it. While trying to hand over identification, Defendants PO Gomez and Does 1-2 then cuffed Plaintiff and stated he was under arrest. Plaintiff repeatedly shouted, "For what?" and Defendants PO Gomez and Does 1-2 told Plaintiff he was resisting and tackled him to the ground. Plaintiff sustained injuries, and the incident was caught on video. All charges against Plaintiff were dropped.
