Description: In the early afternoon on September 19, 2021, the Plaintiff, a 61-year-old woman who is an active and well-known member of her community, called 311 to request that water services be restored to her building. The water had been turned off as a result of the tenants' long-standing battle with an abusive landlord. At approximately 11:00 a.m., two NYPD members arrived at the plaintiff's residence, placed her in handcuffs and arrested her without explanation. The officers took her to the 77th Precinct where she was told that her landlord told 911 that the plaintiff threatened to have her boyfriend shoot him. Description: On October 2, 2014, Plaintiff Khrist Newman was preparing to begin a street performance when stopped by Defendant PO David Gomez and POs John Does 1-2, who demanded that Plaintiff hand over his speaker despite no music emanating from it. While trying to hand over identification, Defendants PO Gomez and Does 1-2 then cuffed Plaintiff and stated he was under arrest. Plaintiff repeatedly shouted, "For what?" and Defendants PO Gomez and Does 1-2 told Plaintiff he was resisting and tackled him to the ground. Plaintiff sustained injuries, and the incident was caught on video. All charges against Plaintiff were dropped.
