Description: On April 30, 2018, at approximately 8:50 p.m., Plaintiff was walking out of a deli at 366 East 188th Street, between Webster Avenue and Marion Avenue, in Bronx, New York. Plaintiff began to walk down 188th Street. He was not behaving in a suspicious manner and he was not ducking behind cars. There was no visible indication of a handgun on his person. Plaintiff continued to walk down 188th Street when NYPD police officers in plain clothing jumped out of a vehicle and began to run towards him without identifying themselves as police officers. Sgt.
