Complaint
Description: On June 17, 2011, Plaintiff was talking to his friend on the sidewalk when the defendant officers asked them to move away from said location. Plaintiff complied and moved. The officers asked the Plaintiff to move for a second time, and Plaintiff again complied. Defendants placed Plaintiff under arrest, lacking probable cause, with his arms tightly behind his back. Plaintiff was then charged with unlawful assembly and disorderly conduct. Plaintiff spent 27 hours in custody before the district attorney declined to prosecute charges because the officers did not observe plaintiff engage in disorderly conduct, block vehicular or pedestrian traffic or refuse to comply with the defendant officers' orders to disperse.
