Description: On November 4, 2011, at approximately 9:00am, Plaintiff lawfully exited the subway 4 train after riding the train without incident and went to the station's upper platform find a working payphone in the station. At no time did Plaintiff commit any crime, break any law, or behave in a manner that would lead a reasonable person to believe Plaintiff committed a crime. The Defendant Police Officers, including Defendant Dennis, approached Plaintiff as he was standing on the upper platform of the station and stopped, questioned, frisked, and unlawfully detained Plaintiff.
