Description: The plaintiff was smoking a cigarette on the sidewalk when he was approached by the defendant offices. The plaintiff along with three other individuals were all put against the wall, frisked, searched, and handcuffed. The defendant officer searched in the gated front area of the residence they were all outside of when he allegedly retrieved a handgun wrapped in a ski mask. The plaintiff was under arrest and taken to the 73rd Precinct. He was charged with criminal possession of a weapon in the second and fourth degree and criminal possession of a firearm.
