On January 5, 2018, a judge had ordered a stay of the warrant of eviction, and on January 9, 2018, plaintiff had obtained and deposited with his attorney the escrow required by the judge. Description: On March 31, 2015, at approximately 5:30pm, Plaintiff Aaron Ross was sitting in his vehicle parked near the intersection of Nostrand Ave. and Kings Highway in Brooklyn, NY when Defendant Assistant DA MARK POSNER allegedly attacked the Plaintiff by reaching through his car window and pounding on his car. When NYPD Officers PAUL GALLO and SGT. KENNETH HERRARTE arrived they searched Plaintiff without probable cause and arrested Plaintiff. Plaintiff was subsequently charged with two counts of assault, two counts of menacing, and one count of leaving the scene of an incident without reporting.
