Description: On April 18, 2016, plaintiff and his wife were legally selling artworks on a Times Square sidewalk when the latter was issued a summons by Defendant P.O. Morales, returnable at Criminal Court. Plaintiff pointed out to Morales that their conduct was not illegal and that the summons should instead be returnable at the NYC Environmental Control Board, and Morales brought over Defendant Lieutenant Khan, who ordered Plaintiff to close down his vendor display. When Plaintiff protested that this decision had to be left to a judge, Khan ordered Morales to arrest him. Description: The plaintiff is a street artist. On the night of the incident, he was approached by two of the defendants, P.O. Morales and Lt. Khan. The plaintiff was placed under arrest in tight handcuffs and placed in a patrol car after the plaintiff told Lt. Khan that he was setting up for the night and had the right to be there. The plaintiff and Lt. Khan have had past encounters of the like. The plaintiff was processed at the Midtown South Precinct. He was later charged with disorderly conduct, specifically, obstructing pedestrian traffic. P.O. Urso was listed as the arresting officer on the arrest report. The plaintiff's charge was dismissed on no PBRD.

Description: On December 25, 2012, as plaintiff was leaving a friend's apartment a police cruiser stopped in front of them. Defendants exited the vehicle, interrogated and searched plaintiff. No contraband was found on his person. Additional officers then arrived at the scene. Defendants subsequently handcuffed plaintiff and threw him into their police cruiser, injuring plaintiff. The DA's office informed defendants that plaintiffs would not be prosecuted, but defendant Almonor nevertheless transported them to Central Booking. Plaintiffs were subsequently released without ever be formally charged of any crime.
