Description: On December 31, 2011, Plaintiff was riding his bike legally in a bike lane in conjunction with protesters moving the same direction on the sidewalk, when an officer pulled him from it. Plaintiff was taken to the 5th Precinct and ticketed for disorderly conduct. The summons was dismissed on March 19, 2011. On March 17, 2011, Plaintiff was present at Zuccotti Park when police cleared the protesters. While restraining Plaintiff, Defendant Officer Eddy Calderon bent Plaintiff’s thumb back and broke it. Later, while restrained on the ground, another officer stomped on Plaintiff’s face twice. Plaintiff was later thrown on the floor of a bus to be taken with other protestors for processing.
