Description: On May 15, 2012, plaintiff was lawfully present inside the 169th St./St. Nicholas Ave entrance to the A/C subway lines at the 168th St/Broadway stop, NY, NY. Defendant Velez assaulted and used excessive force against plaintiff, while he and other officers arrested plaintiff. Officers struck plaintiff with a telescoping baton, and threw her to the ground, causing serious physical injuries. Plaintiff was prosecuted in New York Supreme Court. After a jury trial, all charges against plaintiff were dismissed except Attempted Assault, which was appealed.
