Description: On June 29, 2014 Plaintiffs and partners Cortes and Ruiz, both permanently retired due to disability, were walking home from a bar when PO Richard Herrerabayas and POs John Does 1-4 stopped them and claimed Plaintiff Ruiz was assaulting Plaintiff Cortes. Both Plaintiffs explained they were not fighting and neither assaulted the other in any way. While explaining, Plaintiff Cortes spoke in a loud voice because he is partially deaf. A PO mistook the tone as aggression, spit on Plaintiff Cortes twice, then grabbed Plaintiff Cortes and shoved him into a steel gate.
