Description: On March 15, 2022, the Plaintiff, a 68 years old, partially disabled person, was taking a walk at 1.30 AM when he was mugged and called 911. Instead of treating the Plaintiff like a crime victim, the PO's called an ambulance and forced the Plaintiff to be taken to the emergency room for psychiatric evaluation and possible admission. On the same day, the Plaintiff was discharged by the hospital because there was no basis for the Plaintiff to be admitted or confined for psychiatric reasons. The same evening, the PO's searched the Plaintiff's home without a warrant and alarmed the second Plaintiff, who has multiple sclerosis as well as alarmed the Plaintiff's 95 year old mother.

Description: On April 1, 2015, at approximately 5:10pm, Plaintiff Harvey McManus was stopped by Defendant NYPD officers MARK XYLAS, VAUGHAN ETTIENNE, and RYAN GLAVIN while driving in an unstated location. Claiming to have detected the odor of marijuana coming from the vehicle, the officers searched the car and arrested the Plaintiff who was detained until June 23, 2016. The complaint states that after a Mapp hearing, the Honorable John G. Ingram found that the officers' Grand Jury testimony that they had consent to search the vehicle, that they smelled marijuana, that the Plaintiff's insurance card was expired, and that they conducted an open warrant search prior to arresting Plaintiff were all untrue and not credible.

Description: On February 28, 2014, at approximately 6:30 pm, Plaintiff was inside his neighbor's apartment. The neighbor's boyfriend left the apartment and was beaten up by police officers Vaughan Ettienne and Leonardo Manosalvas and two John Doe police officers outside of the apartment. Plaintiff stood in front of the neighbor's door and watched the police attack. Plaintiff was falsely arrested for assault, obstructing government administration, menacing, and harassment. Bail was set at arraignment for $2,500 and Plaintiff spent 7 days in jail until ROR'd when the prosecutor did not convene a grand jury. After four court appearances, Plaintiff's case was dismissed on motion of the prosecutor.
