Description: On February 1, 2014, plaintiff, who was 52 years old at the time, was getting coffee at his local coffee shop and talking with the store owner when two NYPD officers came in. The officers approached the plaintiff immediately and took him outside, claiming he had participated in a drug sale. Defendant officers then conducted an illegal search, charged the plaintiff with sale and possession of drugs (despite the fact no drugs were recovered) and put the plaintiff in a holding van with no back windows for 6 hours. The plaintiff, who previously had bypass surgery due to a heart failure, complained that he could not breathe and asked the defendants to open a window, but his requests were ignored, resulting in chest...
