Description: On March 15, 2020, Plaintiff was lawfully present in his apartment when Defendants, including PO Eddie Rodriguez, falsely claimed that Plaintiff was burglarizing and trespassing in his own home. Defendants knew or should have known Plaintiff resided there because NYPD had been to the location before, and checked Plaintiff’s ID and verified his residence there. When Plaintiff began to protest that he had lived there and that he had even verified his address to police, he was assaulted, battered and punched about the body, back and stomach and was further slammed into an open elevator causing a contusion to Plaintiff’s right shoulder. Description: On October 25, 2016, Defendants wrongfully touched, grabbed, handcuffed, and seized the Plaintiff in an excessive manner causing him physical pain and mental suffering. Defendants placed Plaintiff in imminent fear of physical contact by approaching the Plaintiff and restraining him. Plaintiff was falsely arrested and imprisoned. Plaintiff was taken to the hospital and members of the NYPD gave false and perjurious statements to the hospital which prompted them to administer unnecessary medication and sedatives to Plaintiff.
