Description: On January 13, 2013, Plaintiff called 911 to request assistance from the police to gain entrance to his apartment that Plaintiff's girlfriend had locked. PO Dominick Martorelli and PO Fausto Gomez arrived at the apartment building and met Plaintiff in the vestibule. PO Gomez told Plaintiff that he could not enter the apartment and that he was going to be taken to the hospital since he had been drinking. PO Martorelli approached Plaintiff and handcuffed him while PO Gomez held Plaintiff in place. Neither PO Gomez nor PO Martorelli told Plaintiff whether he was under arrest or read his Miranda Rights. PO Gomez and PO Martorelli unlawfully escorted Plaintiff outside the apartment building. Plaintiff repeatedly ask...
