Description: On August 12, 2012, Plaintiff was lawfully present in front of 30 W 190th Street in the Bronx. Plaintiff was in possession of prescription medication which belong to Elaine Medina, which the Plaintiff was in the process of bringing to Medina’s at their mother’s apartment (above location). Defendant JAMES LUNDY and “JOHN DOE” stopped Plaintiff and directed him to place his hands on their police car. Dependents patted Plaintiff down and retrieved the bottle. Defendants LUNDY and “JOHN DOE” refused to allow Plaintiff to speak to Medina’s mother and arrested Plaintiff for possession of Controlled Substance.
