Description: On December 3, 2022, Plaintiff McClung attended as an opponent of an anti-abortion protest. As the anti-abortion protesters began to march, Plaintiff McClung and other clinic defenders faced them and walked in front of them to slow their progression. The NYPD played an LRAD recording stating that the protestors must clear the roadway. At this point, Plaintiff McClung was on the sidewalk. Plaintiff McClung stood in the way of the protestors in order to prevent them from entering the clinic. In response, NYPD Defendant Jorge Perez suddenly and without warning grabbed Plaintiff McClung from behind and forcefully shoved him down the sidewalk face-forwards.
