Description: On March 13, 2016, plaintiffs Mario Clotter and Susano Martinez were walking toward one of their own cars while on a night out. On the street, Clotter started talking to some women and Martinez was on the phone with his girlfriend. They noticed a rowdy crowd forming near them, and decided to walk in the opposite direction to avoid the crowd. As they walked away, PO Tolomy Cain and John Does 1–3 confronted them, ordered them to put their hands behind their back, and rear handcuffed them. Despite having no probable cause or reasonable suspicion, the officers put them in an NYPD vehicle and took them to the precinct.
