Description: On April 3, 2012, Plaintiff was hanging out with friends outside a bodega as they observed an NYPD vehicle going back and forth in front of the store. Defendant Officer Roman Navarro told Plaintiff and his friends to leave the area or else they would arrest them, to which Plaintiff replied that they were legally standing there. Navarro and another officer entered the bodega to ask whether the group was bothering the owner, and the owner replied that he recognized the group and that they were not. Navarro and the other officer came back outside and told the group that if they didn't leave in ten minutes, they would all be arrested.
