Complaint
Description: On April 18, 2022, at approximately 1:00 A.M., Plaintiff Nanette Philistin was a patron of Chloe's Lounge located at 9413 Avenue L in Kings County, and Defendant Police Officer Larry Valemar was also a patron of Chloe's. An altercation broke out between the Defendant and another patron, and the Plaintiff attempted to calm the situation. As the other patron was leaving the area, the Defendant punched Plaintiff in the face, pistol-whipped Plaintiff in the upper back and shot Plaintiff in his upper right arm. Before Plaintiff was transported to a hospital, Defendant threatened Plaintiff not to tell anyone who had shot him. Plaintiff brought a claim of vicarious liability against The City of New York.
