Description: On or about December 6, 2011 PO Ivan Rodriguez, Det. Shannon Brooks, Det. Jorge Tobon, Det. Angus Mackenze, and PO Winston Favis forcibly entered Plaintiff's residence by breaking down the door with a battering ram. POs had no warrant to search or arrest, or other legal justification. Plaintiff and other occupants were falsely arrested. POs' stated reason for breaking into the apartment was the smell of marijuana smoke in the hallway. After arrest of the occupants, PO Ivan Rodriguez applied for a search warrant without noting that he had already gained entry to the residence and that the occupants had already been arrested.
