Description: On December 3, 2015, plaintiff was headed home to 320 Lexington Ave, Brooklyn, NY inside a black car service at 11:00 pm, having after consumed alcohol at a friend’s home, when the car service stopped. Plaintiff observed flashlights and numerous plain clothes officers on both sides of the vehicle. Plaintiff observed their hands on their guns holsters and Plaintiff asked the officers, “what did I do?” Officers ordered Plaintiff out of the vehicle. Officers opened the passenger door and pulled plaintiff out of the vehicle, after having instructed the driver to unlock the door. Description: On or about April 18th, 2023, Plaintiff was lawfully driving their vehicle when PO John Edgar stopped their vehicle in front of Plaintiff's vehicle, preventing them from moving. PO Edgar and PO's "John Doe" then approached Plaintiff's vehicle and opened the front passenger side door. PO Edgar then grabbed Plaintiff and aggressively pulled them from their vehicle, threw them to the pavement, put their knees on their back, and handcuffed them. Plaintiff sustained a cut to their wrist as a result of PO Edgar's excessive force. Plaintiff was then taken into police custody, booked, and charged with reckless driving.
