Complaint
Description: Plaintiff was walking out of the train station when he saw defendant officers trying to place a male into arrest and a female crying. The female looked at plaintiff and plaintiff said hey. Defendant officers tried to grab plaintiff's hands but failed. Plaintiff then told defendant officers to chill but defendant officers tried to grab plaintiff's hands and place him under arrests. Defendant officers also assaulted plaintiff in the process. Plaintiff was transported to Transit District 3 and was charged with resisting arrest, obstructing governmental administration in the second degree, and disorderly conduct. The charges were adjourned in contemplation of dismissal.

Description: Officers, acting in concert, used excessive force and covered it up with a resisting arrest charge. Devine made false statements to DA. "The officers responded to the verbal dispute by subjecting plaintiff to excessive force and to assault and battery. The officers, acting in concert, grabbed plaintiff by her hair, struck plaintiff in the head with a police radio, jumped on plaintiff, twisted plaintiff's limbs, kicked and struck plaintiff, and dragged plaintiff down several steps. The officers then took plaintiff outside, lifted her off the ground, and threw her onto the trunk of a police car.
