Description: On November 20, 2013, Plaintiff was shopping with a stroller at Macy's in Herald Square, New York, NY. She had clothing draped over the stroller, under the stroller, and in an open Macy's tote bag she carried. She took the elevator to the less-crowded 5th floor of the store and sat down in public to go through the clothing she had picked out to determine what she was going to buy. She took out the clothing from the tote bag and from under the stroller and never came close to an exit door. A Macy's loss prevention employee approached Plaintiff and accused her of stealing.
