Description: On On January 3, 2014, Plaintiff Helmut Jurkowitsch entered the unlocked door of a Capital One branch located a 31-17 Broadway, Astoria, New York at about 9:40 AM. He went there each Friday to deposit his paychecks. There was no signage to indicate that the bank was closed at this time, and it was not a federal holiday. The lights in the lobby were on, and Plaintiff had no knowledge that the bank was closed at this time. Further, there were two people using the ATMs when he entered. When Mr. Jurkowitsch entered, a couple of Capital One employees were present inside the branch.
