Description: On January 14, 2014 Plaintiff, a limousine driver, lawfully parked his limousine in front of The Hotel Pennsylvania to pick up a client. Employees ordered him to move and Plaintiff explained another vehicle was blocking him in. An employee responded by reaching into the car and striking Plaintiff several times with a closed fist. POs William Bubeck and Arthur McCarthy responded and falsely arrested Plaintiff for assault, despite knowing they lacked legal justification to do so. Plaintiff was transported to a precinct then Central Booking, where POs wrongfully caused charges of assault, attempted assault, and harassment to be leveled against Plaintiff.
