Description: On June 19, 2014, Defendants Duroc and P.O Lawrence asked Plaintiff, who had decided to leave his home to purchase cigarettes from a local deli around 3:00 a.m. and then sit in his car and charge his phone before returning home, what he was doing inside his car. After Plaintiff explained that he was charging his phone, Defendant Duroc asked Plaintiff if he could search him and his car, to which Plaintiff consents. Defendants did not find anything on Plaintiff's person or his car but accused Plaintiff of driving while intoxicated, despite Plaintiff's denial.
