Description: On November 19, 2011, Plaintiff lawfully entered his mother's apartment. Plaintiff's mother had called him after a gunshot was reported at her apartment. When Plaintiff arrived, he observed his brother lying on the floor bleeding from the head and a gun lying next to his body. Defendant police officers arrived at the apartment, unlawfully searching Plaintiff. Defendant police officers knew Plaintiff did not live at the apartment and knew the gun did not belong to Plaintiff. Defendant police offers did not recover any drugs, contraband, or illegal paraphernalia from Plaintiff and at no time did Plaintiff commit any crime or violate the law.
