Description: On April 4, 2013, at approximately 11:45am, Plaintiff JIMENEZ was riding his bicycle northbound on Eighth Avenue in the vicinity of 34th Street when he was forced to stop because an NYPD vehicle was parked in the bike lane on the north side of the 34th street intersection. When Plaintiff stopped directly behind the NYPD vehicle, Defendant officer ESPINAL, who was in the process of writing court summonses to cyclists at the time, demanded that Plaintiff give him his ID. After Plaintiff refused on the grounds that there was no lawful basis for the stop, officer ESPINAL tackled Plaintiff to the ground at which time another officer removed Plaintiff's ID without consent from Plaintiff's back pocket.
