Description: On or about December 17, 2011, outside an apartment building in Brooklyn, Plaintiff David Rodriguez was, without any precipitating act on his part, unlawfully stopped, searched, and arrested by Defendants NYPD Officers Wagner (first name not provided in complaint) and John Does 1-4. In the process of arresting the Plaintiff, the officers exercised excessive force, which involved violently handcuffing, shoving, pushing, and slamming the Plaintiff against a brick wall as well as the hood of the officer's squad car. As a result, the Plaintiff lost a tooth, suffered a gash on his head, and, having had his shirt pulled over his head in the ordeal, lost consciousness. Description: Defendant Officers kicked door down to Plaintiff's apartment, unlawfully entered with guns drawn, and assaulted both plaintiffs and searched their home. Defendant Officers then left the premises without charging Plaintiffs with anything. Plaintiffs called an ambulance to come get them and then some Defendant Officer researched Plaintiff's apartment while they were gone and Officer Gaudioso met them at the hospital and forced unnecessary medical tests on the Plaintiffs.
