Complaint
Description: On June 1, 2013, Plaintiff was sitting on the back of a neighbor's car, talking with a friend. Defendant Officer Baldo drove up to Plaintiff in an NYPD patrol car and told him to get off the car, which Plaintiff did. Then Defendant Officer Baldo stated that he was going to arrest Plaintiff, to which he demanded for the reason. Defendant Baldo got out of the police car and arrested Plaintiff's friend instead of Plaintiff, and put him in the patrol car. When other officers arrived, they surrounded Plaintiff, grabbed, punched and handcuffed him. Plaintiff as then placed into one of the police cars and driven to 33rd precinct. The DA refused to prosecute Plaintiff.
