Description: On October 30, 2012, plaintiff, a 22-year-old African-American male, was arrested by NYPD officers Michael Calder and John Warnock and charged with Burglary in the Third Degree among other offenses. The charges stemmed from officer Calder alleging that he observed plaintiff being handed a pair of boots taken from a store damaged by Hurricane Sandy. Plaintiff was held on $35,000 bail. Both plaintiff and officer Calder testified before a grand jury on November 2, 2012, and plaintiff was released after the grand jury returned a no bill, dismissing the action. Plaintiff spent approximately four days in custody and incurred substantial legal expenses due to officer Calder's false allegations.
