Description: On July 9, 2010, Plaintiff's car was sideswiped by an unmarked police vehicle being operated by an officer. Plaintiff pulled over while the officers approached the car. While Plaintiff was reaching for his registration and insurance documents, officers approached the car with guns drawn and yelled at him to get out of the car. The officers forcefully pulled Plaintiff out of the car and began beating Plaintiff with a baton and the butt of a gun. After being arrested and taken to the precinct, Plaintiff was charged with Operating a Vehicle While Intoxicated and Refusal to Take Breath Test.
