Description: On August 25, 2011, plaintiff Kareem Bell was on the subway when defendant NYPD Officer John Kehoe told him to turn off the music on his phone. Mr. Bell stood up, said that he is getting off the train, and exited the train (the music stopped by itself while he was still on the train, as his phone began ringing at that moment). Defendant Kehoe followed Mr. Bell off the train and shouted "Come here." Mr. Bell responded by asking why, since he had turned off the music, whereupon defendant Kehoe shoved him to the ground. Mr. Bell said "you have no right to touch me" and began walking away, whereupon defendant Kehoe shoved Mr. Bell into an emergency gate. Mr. Bell then walked away. Defendant Kehoe followed him and p...
