Description: On July 13, 2017, at approximately 9:00 p.m., Plaintiff was a passenger in a vehicle near 40-12 128th Street, Queens, New York, when Police Officer Daniel Frasca directed the vehicle to stop. The vehicle's driver had not committed a traffic infraction, and there was no reasonable suspicion or probable cause for the stop. After the vehicle was stopped, Officer Frasca ordered all occupants, including Plaintiff, to exit. Plaintiff was then forcibly grabbed, handcuffed tightly, and arrested by Officer Frasca, who falsely accused him of possessing marijuana.
