Description: On July 4, 2020 Officers Brillante and Barry began following Plaintiff's Eduardo Boscarello vehicle out of a church parking lot. They did not turn on their lights/sirens, activate their body cameras, or inform the dispatcher that they were following Plaintiff. They deactivated their vehicle's AVL and DASLITE history to keep their pursuit hidden. They used their vehicle to cause Plaintiff's vehicle to crash, and sped away until a civilian flagged them and told them of the accident. Defendants exited the police vehicle and punched Plaintiff in the face, handcuffed him, continued to punch him in the head, brought him to the 81st precinct station house, and then the Woodhull Medical Center. Defendants later maliciously prosecuted Plaintiff on false claims that Plaintiff walked into traffic, refused to provide officers identification, and told officers he would kill them.
