Description: On April 30, 2018, at approximately 8:50 p.m., Plaintiff was walking out of a deli at 366 East 188th Street, between Webster Avenue and Marion Avenue, in Bronx, New York. Plaintiff began to walk down 188th Street. He was not behaving in a suspicious manner and he was not ducking behind cars. There was no visible indication of a handgun on his person. Plaintiff continued to walk down 188th Street when NYPD police officers in plain clothing jumped out of a vehicle and began to run towards him without identifying themselves as police officers. Sgt. Michael Whelan and Officer Valdrin Nikqi observed Plaintiff walking down the street, but at no time did they observe him commit a crime or behave in a manner than would...
