Description: On October 28, 2010, Andre Graham was unlawfully arrested and charged with criminal possession of a weapon in the second degree by Detective Roy Schmal, Sergeant Gerson Lopez, and Officer Andrew Seewald of the New York City Police Department (NYPD). The officers acted within the scope of their employment and authority, under color of law, and pursuant to the official policy of the City of New York. Graham was convicted at trial in Supreme Court, New York County, but his conviction and sentencing were reversed, and the indictment dismissed by the Appellate Division, First Department on May 26, 2015.
