Description: On October 8, 2019, Plaintiff was working at Apple Tree Karaoke Café in Queens. Defendants, Sergeant Jung Kim and Officer Hyun Kim, came to the café, where they were seated in a private room. Defendants consumed alcohol and began to behave rudely. Defendant Hyun Kim then brandished his firearm and pointed it at Plaintiff in a threatening manner, ordering Plaintiff to stay and threatening to kill her otherwise. Because of these actions, Plaintiff had her freedom of movement curtailed. Moreover, Defendant Hyun Kim characterized Defendant Jung Kim as his boss, but Defendant Jung Kim did not intervene or do anything to stop Defendant Hyun Kim.
