Description: On September 27, 2017, Detective Richard Rodriguez and Officer John Doe #1-2 (defendants) unlawfully seized and searched the Carlos Rios (plaintiff) without consent, a warrant, probable cause, or reasonable suspicion.
The defendants were in plainclothes and exited an unmarked minivan with guns drawn which prompted the plaintiff to run away in fear during which he tripped and fell. While he lay face down with his arms outstretched, the defendants kneed him in the back, handcuffed him, and attempted to lift him from the ground by the handcuff chain, causing the plaintiff to sustain a fractured wrist. Only a small bag of marijuana was found, the unlawful actions against plaintiff were partly based on profiling.
