Description: On December 5, 2012, plaintiff went to visit his wife and children at their apartment. While there, defendant NYPD Officers XX Mastromatteo and XX Leone arrived and asked plaintiff to leave. As he did, defendant Mastromatteo pushed plaintiff into a stairwell, which caused plaintiff to hit his face on a window ledge and cut his finger. Mastromatteo then pushed plaintiff against a wall and struck plaintiff with his radio. Defendant Leone did nothing to prevent this conduct. Defendants then arrested plaintiff and made false reports which caused plaintiff to be charged with disorderly conduct.
