Description: On June 2, 2023, plaintiff was operating a vehicle near 1415 Townsend Avenue, Bronx, New York, when defendant NYPD officers stopped him. Plaintiff crocked his window open to speak with them, and asked what the basis for the stop was. Defendant officers broke the window and proceeded to assault plaintiff, swinging at and hitting him repeatedly in the left side of his body. Plaintiff was not engaged in any suspicious activity and the stop and frisk was improper and unreasonable. Plaintiff was not in possession of any contraband or items that could reasonably justify his arrest. Not withstanding the lack of probable cause to arrest Plaintiff, Officer Seder handcuffed Plaintiff and transported him to the precinct. The DA's Office subsequently declined to prosecute Plaintiff.
