Description: On August 4, 2019, Plaintiffs Tysheem Rivera, Jeremiah Perez, and Denzel Hart were lawfully present near Ellery Street and Marcy Avenue in Brooklyn, New York. They were stopped, detained, arrested, and searched by Sergeant Martin Gimenez, Officer William Campbell, and several unidentified NYPD officers without probably cause. The defendants wrongfully searched at least one interior compartment of Plaintiffs' vehicle without probable cause. Plaintiffs were detained at Housing PSA 3 as a result of the Individual Defendants’ actions, and were eventually released with Desk Appearance Tickets (“DAT”) charging them with CPL 221.10, a violation for which custodial arrest was not authorized under New York law.
