Description: On May 30, 2020, plaintiff (an African-American male) was peacefully protesting the deaths of George Floyd and Breonna Taylor. Plaintiff and other protestors observed several NYPD officers accosting and assaulting a black male protestor, and some of them asked the officers to not hurt the protestor. Plaintiff said nothing to the officers and did not interfere in any way. Plaintiff again observed a NYPD officer assaulting another protestor. Plaintiff and other protestors asked the officer to stop in an effort to de-escalate the situation. Lt. Description: On May 30, 2020, plaintiff while in the street photographing, was forcibly pushed to the ground by P.O. Luigi Tirro. Plaintiff was then pulled from the sidewalk and restrained by Lieutenant Robert Cattani and PO Tirro. Plaintiff was t surrounded by officers including PO Nicholas Terrent and handcuffed. Plaintiff was then re-cuffed and detained by PO Leonel Girron and Adam Muniz. Plaintiff repeatedly explained that he was a member of the press and asked that defendants look at his credentials, to no avail. Complaint
Description: On March 22, 2018, employees of a charter school reported to the NYPD that the plaintiff sent a text message to another staff member saying, "If I get fired on Friday, I want to make sure that the whole building burns." On April 10, 2018, the plaintiff was arrested for aggravated harassment and falsely reporting an incident. However, the NYPD should have known that the arrest was illegal because in 2014 the Court of Appeals held the aggravated Harassment statute to be unconstitutional. There was no immediate threat made by the plaintiff.
