Description: On November 26, 2013, Plaintiff had gone through a subway turnstile when he realized his cousin, who was following him, was being arrested by the police for not paying his fare. Plaintiff questioned the officers, who then surrounded him. Defendant Officer Richard Fazio shouted profanities at him. Defendant Officer Kelly Rios then pepper sprayed Plaintiff in the face. Other officers grabbed Plaintiff and took him to the ground while others struck Plaintiff’s face and head. While being transported to Transit District 1, Defendant Fazio made derogatory statements about Plaintiff's wife, which promoted Plaintiff to spit in the Defendant Fazio’s face.
