Complaint
Description: On September 6, 2013, Plaintiff was in the vicinity of Boston Road and 169th Street, in Bronx, NY at approximately 10:30 pm. Plaintiff saw an Margarte Rivera, an acquaintance standing at a payphone the sidewalk, and Rivera wasn't feeling well. Plaintiff tried to convince Rivera to come home and sober up, but Rivera got mad and started hitting plaintiff with the payphone on his hands and chin, injuring Plaintiff. Defendants, the NYPD drove by and Plaintiff waived down the NYPD for help. the NYPD stopped in front of them and an NYPD officer exited his car and saw Plaintiff's injuries. Description: Plaintiff was working on a car at his job as an auto body shop when PO Jimenez drove his car up, got out, and asked Plaintiff where he worked and if he had a license or was on parole. Plaintiff's boss was not at the shop to verify that he worked there and so PO Jimenez arrested him, brought him to the 42nd Precinct, and charged him with Driving without a license.
