Description: On April 16, 2014, Plaintiff was lawfully inside his apartment when his wife decided that she wanted to be alone in their apartment and asked him to leave. When Plaintiff refused to leave the apartment, his wife called 911. When the defendant officers arrived, they lacked any basis to order plaintiff to leave his apartment because he had not committed any crime. Nevertheless, the police officers falsely told Plaintiff that there was an outstanding order of protection that stated he had to stay away from his wife, and he was in violation of the order of protection.
