Description: On or about January 4, 2021, at Plaintiff's home, he was handcuffed and arrested by Defendants including Detective Javish Ortiz. No time had Plaintiff been involved in any unlawful or illegal activity or did Plaintiff possess or exercise any custody and control over a firearm. Prior to being arrested, Plaintiff was the victim of a shooting wherein he was shot in the left ankle. As a result of being shot, Plaintiff's left leg was casted and he required the use of crutches to walk. When Plaintiff was arrested he was handcuffed to his crutches. On or about January 5, 2021, Plaintiff was released from custody after the Office of the Bronx County District Attorney declined to prosecute the arrest.
