On April 3, 2004, at approximately 1:00 AM, [redacted] and his cousin [redacted] exited the Langston nightclub located at 1073 Atlantic Avenue in Brooklyn after a dispute erupted inside this establishment. As the two men walked along Atlantic Avenue, [redacted] remembered that he forgot his coat inside the nightclub and returned to retrieve it. As [redacted] waited for [redacted] at the corner of Atlantic Avenue and Franklin Avenue, he was approached by PO Keith Chatterton who instructed him to walk away from the corner. [redacted] informed the officer that he was not going to walk away because he needed to meet [redacted] at this corner. When PO Chatterton asked him to walk away for the second time, [redacted] told the officer in a loud tone of voice that he had the right to stand at this corner. An unidentified uniformed officer approached [redacted] and tried to convince him to walk away from the area. As [redacted] spoke with this officer, he was pepper-sprayed by PO Chatterton.
