On September 8, 2004, [redacted] was driving down Davidson Avenue in the Bronx. He was driving behind an unmarked vehicle in which Officer Jeffrey Carroll, Sgt. Kevin Maloney, and Officer James Leo, all plain-clothes, Anti-Crime officers from the 52nd Precinct, were occupants. According to [redacted] the unmarked police vehicle was driving dangerously and he honked his horn once to make them aware that he was behind them. The officers pulled the vehicle to the side and allowed enough room for [redacted] to park his vehicle parallel to theirs. When the two vehicles were side-by-side, [redacted] who at this point did not know he was speaking to police officers, addressed the officers in the vehicle. He alleged that Officer Carroll, the driver of the unmarked officer vehicle, spoke to him in a discourteous manner and informed him that he needed to stop his vehicle because he was going to issue him summonses. After his summonses were written and handed to him, [redacted] requested the names and shield numbers of all three officers present at the time of the incident. He alleged that Sgt. Maloney laughed and looked in another direction when this information was requested of him. Sgt.
